I'm sure the idea is that the right is intrinsic, and something that one has to actively forfeit, like the right to breathe - nobody has the authority to "give" this right, or to take it away arbitrarily.

Ok I agree with that. But since those times the nature of the game has been changed drastically. Now we no longer have the "survival of the fittest" society that we had back when all these rights were really needed. As the playing field changes, so should the game.

It's intrinsic but it has also been formalised.

"Men and women of full age, without any limitation due to race, nationality or religion, have the right to marry and to found a family. They are entitled to equal rights as to marriage, during marriage and at its dissolution."

Article 16 - Universal Declaration of Human Rights.

I answered above about why maybe we should re-think intrinsic rights, when i responded to Khuutra. If the playing field changes, then shouldn't the game change accordingly as well?
