I don't know if this is a Nintendo/Microsoft problem, perfect dark is already avalieable on xbox live, right?
I think it's more about making an agreement with those who currently have 007 game publishing rights (don't know if it's EA or Activision).

There are enough parties to spread blame around.
But what would prevent the developer (Rare) of the non-releasable XBLA version to make it a generic spy game rather than a Bond game and try that route?
If the game is so great, then the license should not matter. And from what I understand, that is the biggest sticking point.
My guess is that much of the interest is because of the nostalgia factor -- and the game will not hold up as well if it is not Bond.

nintendo co-owns the rights to golden eye still thats why microsoft and nintendo are having a problem.
