Tatoos? Really?



Well, when NBA players gave permission for 2K to use their likenesses, then the tattoos on those players came with the package unless explicitly excluded from permission. If, however, the tattoo images are available to be used on the player created character then tattoo copyright would come into play and there could be a legit case.

If it is a violation of copyright to reproduce a tattoo's image on a person then it is a copyright violation for anyone to publish a photograph of someone with their copyrighted tattoo visible. So that would require magazines and websites to photoshop out tattoos in their publications.

Next, they'll complain that they used their "skin tone" without permission... guess everyone wants a piece of the pie.



Made a bet with LipeJJ and HylianYoshi that the XB1 will reach 30 million before Wii U reaches 15 million. Loser has to get avatar picked by winner for 6 months (or if I lose, either 6 months avatar control for both Lipe and Hylian, or my patrick avatar comes back forever).

So according to Oak Sketches the players don't own the rights to their own likeness, their appearance is copyrighted by Oak Sketches!

So if LeBron James' did a self portrait he'd better shell out to Oak Sketches!



Unless you had the ability to customize other players with those same tatoos, then the case is weak sauce.

Forget a self portrait, he couldn't post a selfie on Twitter or Instagram without being sued, if this was how copyright on tattoos worked, which I'm sure it doesn't.
