Man Sues Bethesda Over His Fallout 4 "Addiction" - Report

He wants $7,000 for "emotional distress."

According to a report from Russian state media RT, a man from Krasnoyarsk is suing Fallout 4 developer Bethesda over his "addiction" to the RPG, which he claims led to him losing his job and wife, among other things. He's seeking 500,000 roubles (around $7,000) for emotional distress (via Destructoid).

The man saw an advertisement for Fallout 4 and downloaded the game, intending to only play "for a couple of evenings." But that's not what happened. He apparently skipped work to play Fallout 4, which led to his termination. The RT report also says the 28-year-old stopped hanging out with friends, while his wife left him, and his health started to fall apart apparently as a result of constantly playing the game.

"If I knew that this game could have become so addictive, I would have become a lot more wary of it," he said in a statement to RT. "I would not have bought it, or I would have left it until I was on holiday or until the New Year holidays."

According to RT, there has never been such a case in Russia. The man's legal representation claim they want to "see how far we can go regarding this case." A Russian localization company is also named in the lawsuit.

There is some precedent globally, however. In 2010, a Hawaiian man sued Lineage II developer NCSoft, claiming that he was "unable to function independently in usual daily activities such as getting up, getting dressed, bathing, or communicating with family and friends" as a result of his "addiction" to the game. He claimed to have played 20,000 hours of the game between 2004 and 2009, according to Wired.

A federal judge allowed the case to proceed. RT reports that the court actually sided with the man, somewhat at least, ordering NCSoft to pay his legal fees.

If this case wins then wouldn't any form of entertainment be subject to such law suits? I guess we can put warning labels on everything could be addictive.

Eh, people just do this for media attention. It's hard to even care or be outraged anymore. The judge will throw it out, everyone will have their fun, and we'll all move on. Making a product "too good" will never be against the law. I could just as easily say I have an addiction for any other thing because I like it too much.



It's called accountability, guy. He chose to play this game an excessive amount, to the point where it affected his personal life. This is nothing but his fault, but he refuses to take responsibility. He just needs to grow up and stop blaming others.

Yeah. James Cameron and FOX studios would fall under this. With Titanic and Avatar, as an example.

cases like this NEVER win. even the news report about this only could find a case in which someone made a similar ludicrous claim and got their court fees reimbursed (but nothing else)

its an illogical sort of case and has no standing in the court of law because an individual makes their own choices to purchase and view entertainment and spend time on it

no worries regarding the validity of this sort of case. you can sue for whatever you want but that doesn't mean anyone cares. that famous case of the Mcdonalds woman who got coffee spilled on her, I believe I heard that despite the original ruling she ended up not actually receiving the ridiculous amount she had sued for, or having to return it or something or other

the justice system in general might be a mess but you still cannot claim much if your complaint is based on your own actions and choices

I am going to predict that his streak of bad luck isnt going to stop here cause he will lose this court case aswell!

Can you imagine if this went through? How many people would sue Blizzard for WoW? xD
