Possibly pariety reasons. Nintendo and Xbox have a strong relationship and im sure Nintendo isnt kicking a fuss over it. The deal was more to satisfy Sony and the FTC then Nintendo. CoD was never a top seller on Nintendo machines which will explain the lack of urgency from both parties.
