Pretty weird indeed. They took all the cautious to contour this problem on PS5, but with Switch looks like they didn't even care or they thought it would slide with no hard consequences. 

Like, the game was all praise on the internet after its release. You would thought they got the buck to do a separate version for Japan just like they did with PS5 when the game was still under the sheets. 

Now they have to deal with refunds all the way until fix this... Well... Choices 

The CERO and them refusing to do a second version for the west was just speculation.

Ad-hocs latest statement doesn't seem to support that at all. They obviously knew CERO's requirements, it was not passing Nintendo's platform and content guidelines that took them by surprise. They specifically states they didn't meet Nintendo's content guidelines.

"Any game that’s going to be on the Nintendo platform needs to ‘meet [Nintendo’s] established content and platform guidelines.’ This is the key point. Nintendo has content guidelines. Our game didn’t meet those guidelines, so we made changes that would allow us to release on their platform. That’s what happened here. Honestly we thought this would be obvious since we’re the devs that released the fully uncensored version of the game on other platforms.

We initially assumed, like some of you, that because games like Witcher 3 and Cyberpunk are on the platform with similar types of uncensored mature content, Dispatch would be allowed to do the same. During the porting process it became clear that was not the case"

They say they are now working with Nintendo to address it.

"We’re already working with Nintendo on a path forward. While we can’t make any specific promises just yet, we’re confident we’ll be able to push an update to address at least some of the censored content."

Here's what I think happened. They were planning to release fully uncensored on the west. The uncensored version didn't pass Nintendo's content guidelines for some reason. They then didn't have time to go through the approval process multiple times trying to get a partially censored build to pass so instead released the fully censored Japanese build in the west because they knew that'd pass.

They're now going to work with Nintendo to uncensor as much of the game as they possibly can.
