That's a big shortcoming from Nintendo if true, but the publishers made the wrong choice too, I can't imagine the market for Dispatch being big in Japan, so skipping releasing it there, at least until they can sort something out with Nintendo, would probably have been a better strategy.
What makes it even weirder is that Nintendo allows multiple versions based on region if the publisher is different at the very least.
