Nintendo's Pokémon Catching-Related Patent Has Been Rejected In Japan

Shin Megami Tensei predates Pokémon by a decade anyway. Doesn't require throwing anything but I'm sure there are games that do something similar that might predate it in some way. It's a dumb thing to try and lock this down.
