Its not about making things painful to MS because this isn't a MS thing, this is how businesses work in the US. What they should concentrate on is making sure they are fairly treated and that when layoffs does happen they are well compensated with insurance and severance pay. Believing they are going to punish MS for deciding to move in a different direction if they so choose will not only not work but will be a sure fire way for MS to punt the whole division away.
