You're asked but if you refuse you can't play the game it straight up tells you that the game requires an update to be played do you want to proceed to update. I've had it a few times on 3DS particularly when I bought Fire Emblem Fates and once with Wii U, other platform holders have this as well in fact Sony were the ones to introduce it with the PSP.
