Yes, if he hasn't responded to the challenge 5 days after the challenge was made, you take his spot. But if he accepts the challenge, he has another 5 days to have to fight even though he accepted some days after he was challenged. This means the challenged person has 5 days to accept the challenge + 5 days to take the challenge.
