Yes, but he can't send them further than that, so even if they were pushing forward again, which they would need to to win the war, Russia couldn't send them into battle.

I'm not sure how it's legally considered in Russia, but I believe much of those occupied territories Russia considers its own are actually still under the possession of Ukraine. At this rate, Russia won't have to worry about the legality of using conscripts in attacks in a very long time, I suspect. Now whether using conscripts as carelessly as volunteers is politically sound could be another issue entirely...
