Yep, and then when you put "start the game" it says "you really need to update it first"

I'm 99% certain that I've played games that had an update ready to install without actually installing it. Metroid Dread comes to mind. 

But even if I was wrong, in the case I'm concearned about, once the eShop closes up, there won't be an update to download, so that message won't even appear.
