Why doesn’t Nintendo include digital sales?

Possibly because some companies reveal their digital sales and others don't so they can only release what they have received of digital sales. So is they being unfair to Nintendo or Nintendo isn't telling them the data that other companies tell?

It's not about being fair.  It's about actually reporting consistently, which the NPD does not do.
