In the United States, scalping is illegal to varying degrees only in 15 states, I don't know if consoles are covered by the laws that do exist (most of the scalping laws revolve around ticket sales, which are for one-time events rather than a product that will last for an indefinite amount of time), and law enforcement isn't going to waste valuable time or resources on hunting down someone selling a $1000 PS5 or XSX. But yeah, if people would be patient there will be plenty of consoles, and scalpers would be discouraged. But they aren't patient, and scalpers aren't discouraged.
