So you're looking at a patch to be required to get that running at that frame rate on PS5. It's not going to get a higher frame rate because the games coding doesn't allow it.

This is what I have been saying. If a game is capable of higher frame rates and resolution then those will improve. But if the game is locked at a specific specs, then the improvements will be far less pronounced.

And if a hacker can lift the restriction, the developers can't for new hardware?

They can, but that was twintail explaining why the game wouldn't automatically be 4k60fps if the code somewhat capped to 1080 or 30fps. If there is a hard code preventing it, then it would need a patch even if very small.
