^Actually I am pretty sure they own the rights to publish the first 2 games, which would be Gears 1 and Gears 2. They do not in any way own the right to the franchise, the IP is owned by Epic.
Epic can put Gears 3 anywhere they want. MS can't do anything about it either unless they pony up some more dough.
