That's because Intel measures at base clock speed.
AMD is a bit difficult to measure, as it's cooling affects the TDP budget.
But in the case of a 9900K, unless that one is locked by hand to 95W, it will consume more than a 3900X. If a 9900K is locked, then it consumes about as much as a 3700X
