They actually have full control of the IP, the ownership is split 3 ways between Creatures, GF and Nintendo but Nintendo own the controlling stake in Creatures from when they were still called Ape (the studio behind the Earthbound games).

But I meant more on the development side of things. Nintendo has not been more than a publisher for the Pokemon franchise. I don't know if they can simply take development rights away from Game Freak unless a deal is made.
