Fair enough, but one last question, please. Why do you think it's prosecutorial discretion? My understanding was that the FBI investigates potential crimes, and then hands it off to the Justice Department for prosecution. Prosecutorial discretion per se would come into play at that point, and not during the initial investigation, I would think.
If even this is something you no longer care to answer, I can accept that.
