Just like any other IP collaboration between a console manufacturer and a third party, you can't call it a straight-up first party game nor a straight-up third party game. However, due to the involved factors it is clear that the game in question is effectively a first party title despite being published by a third party*, so it makes much more sense to count it towards first party games rather than third party games. Fire Emblem Warriors, Hyrule Warriors: Definitive Edition and Pokken Tournament DX are also first party titles for the same reason.

*All four games mentioned in the above paragraph are actually published either by Nintendo or the respective third party partner depending on region, so determining first party or third party on the basis of publishing cannot lead to a clear result.

That still isn't how it works. The games you mentionned have nothing in common with Mario+Rabbids. It's an Ubisoft game, from the whole Rayman VS Rabbids franchise. It's more like a game where the Switch version have exclusive content (like the hylian shield in Skyrim) than a nintendo game.

 

Ubisoft asked Nintendo if they can use Mario characters for their games, and was shown during the Ubisoft conference. It may soind stupid but having Mario in it doesn't make it a Nintendo title. Just like Smash bros.
