The site/moderators. Sure, they can never be completely objective, but there are a lot of things that clearly shouldn't be allowed. There are laws against hate, and sites shouldn't let their users break these laws.

Yes but this can also be abused and end up with SJW's and PC rules. In other words a dictatorship of what can and cannot be said.

Also what you consider hate is not necessarily what I consider to be hate and vice versa. Some people consider criticizing religion as a "racist" thing and hate speech. So does that mean if we disagree with a religion we must pretend we agree with it and trying to freely talk about our opinion on that religion should mean legal trouble for us?

I could consider such a lack of free speech as fascist, others would think of it as progress. So you see, even determining what is hate speech is not so simple.
