If EA were to lock content behind figurines then you can guarantee that they would lock the best content, the things that everyone would want. Nintendo get away with it because they lock less exciting things, or often nothing at all (see SMO). The difference between Nintendo and other companies isn't that Nintendo get a free pass just 'cause they're Nintendo, but because Nintendo know where that line is drawn and are careful not to step over it. On the occasion when they do, such as with Mario Party 10, the backlash is there.
