Technically it might be the act of downloading a ROM is illegal and not playing the ROM of a game you don't own, but I'm not sure. Either way, that's just a minor detail that has no effect on your point, which sums up the situation really well.

You got my point, so arguing the semantics of wording seems pointless  ;)
