It's probably because they'd prefer stability, because if one of the companies fall it could affect the other too, so they're trying to maintain the status quo.

Huh? Sony has tried numerous times to make Nintendo-like games for their consoles, including several attempts at Mario Kart. There's no gentleman's agreement here, only Sony failing time and time again while NIntendo has no need to imitate any of Sony's games because none of them are big sellers in Japan. Additionally, Nintendo made the effort to get Monste Hunter exclusively on the 3DS which impacted the prospects of Sony's Vita tremendously; and now rumor has it that Sony paid Capcom to keep Monster Hunter World away from Switch.

Nintendo and Sony are definitely not on good terms with each other.

They tried to make Nintendo-like games, but I honestly don't think they ever expected them to be the huge successes that Mario Kart and Suepr Smash Bros. are, more that they're trying to fill as many genres as possible for potential buyers. They may not be on good terms with each other, but they'd rather them both be there than a situation where both of them are at risking failing or having to deal with outside threats.
