Do you have an NNID linked to your 3DS? When I bought my new 3DS, I had to interrupt the transfer process, and discovered that all my digital purchases were just sitting there, waiting to be redownloaded, including the ones I bought before linking my NNID. The process to download them again was so simple...it honestly surprises me that people still worry about this kinda thing.

Of course, NNID implementation didn't happen until a year or two ago, but still, this doesn't really seem like news anymore.

Yea I was able to transfer my eshop purchases to my New 3DS XL from my original 3DS.  Only problem was the save files fucked up during transfer so I lost all my eshop games saved files.  Wasn't the end of world but it sucked losing my Animal Crossing New Leaf save file (one of only 2 retail games I purchased on eshop).  Ended up restarting game and probably creating a better village but I wasn't too happy at first.  It did get me to play previously beaten games again that I might not have gone back to.  Basically it sucked the transfer messed up for the saved files but I still was able to redownload all the games (took a hour or so considering I have a shitload of eshop games).

However, he is worried about his system crapping out on him.  If that happens then he would have to contact Nintendo Customer Service to try and get his games onto a new system.  Have to jump through a few hoops but I believe the Customer Service Reps can fix the issue of getting previous purchased games onto a new system if the previous system was lost or damaged.
