Depends on the country/region you reside in.
Many sensible nations state that "Pirating" is illegal.
But "Backing up" is legal and Emulation is legal.
With a couple of caveats. I.E. You can reverse engineer a BIOS, but you can't emulate/duplicate one. And you can't circumvent the copyright mechanisms... But if someone else has circumvented the protection and released the ROM, then that can be classed as legal in some places to acquire.
And in some nations, Roms, Emulation, Circumventing security is all perfectly legal. In other nations, it's all illegal. It's all a hot mess.
It's all a mess really. I am of the belief that Emulation should be embraced, it preserves digital media and digital environments that might otherwise fall into obscurity never to be seen again.
