I wish they would aim at some more adult games like that as well as their regular IP, but the reality is Nintendo does this with virtually all of their trademark sort of things just 'in case'.
If you're not active with trademarks I think you can sometimes lose the copyrights over certain properties and we all know the big N is pretty OCD about maintaining legal possession over their things
