No X-Men characters means no Wolverine, Cyclops, Storm, Phoenix, Deadpool, Magneto, Sentinel... No Fantastic 4 (they don't have their rights yet) means no Human Torch, the Thing, Doctor Doom, probably Galactus... Marvel can use any character they want. They only licensed out the movie rights to X-Men and Fantastic Four. Marvel doesn't like to use those characters in games because they are trying to diminish their popularity in order to regain the rights. Capcom had to fight with Marvel to get X-Men characters in MvC3.
