Well they aren't owned by Microsoft I don't think? So I guess that gives them some freedom.
'The Coalition' devs were working on something then told to do Gears (and with the name change) for the foreseeable future.
There's only 2 races: White and 'Political Agenda'
2 Genders: Male and 'Political Agenda'
2 Hairstyles for female characters: Long and 'Political Agenda'
2 Sexualities: Straight and 'Political Agenda'
