Ohh wait, that kinda did happen with titles like Alien: Colonial Marines. Lawsuits were filed over that.  I think that's how the phrase "bullshots" game to be. It was a big deal. Why should Nintendo get a free pass if that turns out to be the case here?

Its written at the end of the trailer that "game images are not final and may not represent that game" or something of the like.No9body is being misleading here.

Fine letters are almost the exact definition of misleading, because you show one thing with the intent of other and make very little effort to prevent the confusion.
