MS said its up to developers how they want to utilize the power in Scorpio, so no one if forced to do 4k or 60fps.
And a $400 price is unlikely considering Phil said "premium price", and Digital Foundry who are well versed in tech and know how prices change over time still said they expect Scorpio to be at least $500 at launch.

I never said all games will. I said it can and will have games at 4K. Of course, premium price has a lot of connotations, especially since we have no idea if the GPU will be new or even if the console will have similar specs. Depending on how they upgrade the thing, the price might go further, but it's as good as any guess given what we've seen before...
