Nintendo "gets away with it" because the greater majority of their customers honestly don't know enough about this sort of thing to care. And it's nothing new; Virtual Console has always been set up in the same sort of awkward interface. People complained (briefly) about that, yet I don't see anybody declaring VC to be a failure just because it panders less than 100% to the most dedicated users.
