The problem with a company allowing fan games is that it sets a legal precedent for others to legally copy their trademarks. It is part of the law that a company must defend its trademarks, or it loses their rights to them.

What Nintendo should have done is hired these people, gave them a job and released the game properly.

Nintendo also tends to attack and shut down youtube video's as well, Nintendo is very strongly against anyone who produces content that even hints towards Nintendo's I.P. these days... And Nintendo should be ridiculed for it, Sony and Microsoft, heck most companies don't go to such lengths, many companies even support such efforts.

I don't think just hiring random people works like that, especially if we're talking about video games or films or shows.

As for YouTube, it's hard to tell because the news of Nintendo monetizing videos kinda died down for me as time went by. Plus, Nintendo has been involved on YouTube through their channel and having devs and others being guests for interviews and other stuff. I remember a cooking channel guest starring Miyamoto and Trinen, Game Theorists debating against Reggie, Nintendo Minute having YouTube stars and Smash Bros. players as guests.
