I don't think anyone is arguing that as the issue. Nintendo should protect it's I.P when it is being infringed.

I think the issue is that Nintendo likely knew abouts this project since it's very early days (Heck, I did.) and allowed the maker to proceed for almost a decade, essentially wasting a massive chunk of that users life.

What Nintendo should have done is hired these people, gave them a job and released the game properly.

Same wen't for that Metroid 2 remake, almost a decade of that users life was spent building that game and Nintendo shut it down once it released.

Nintendo also tends to attack and shut down youtube video's as well, Nintendo is very strongly against anyone who produces content that even hints towards Nintendo's I.P. these days... And Nintendo should be ridiculed for it, Sony and Microsoft, heck most companies don't go to such lengths, many companies even support such efforts.
