If in fact this DMCA was issued by Nintendo. I recall reading recently of people posing as Nintendo and issuing C&Ds.

Sadly, it is. The developer confirmed it was real and removed the download link from his website.

Well here's to the game getting in as many people's hands as possible regardless.
