I wouldn't be stunned if they are using a free form LCD display which could be widescreen on the top but extend downwards from the middle creating a weird but distinct shape.
This would allow it to run DS/3DS VC games (two screens stacked down) and Android apps that use the vertical configuration without having to move the screen around.
That would also explain what the deal with Sharp for a free form LCD was about.
