Who's responsibility? Nintendo's? Well, I'm not really sure how court works, but I think it would be kind of unlikely Nintendo's fault if the person in question got injured from say, getting hit by a car, getting into an accident, or driving into a tree. It's not the app's fault. The person should have been paying attention If it was that simple, there would be a lot of sueing going on involving the app already. |
Ohhhhh man, you have no idea on what courts accept as suits.
You have an refrigerator, that you are supposed to put things inside to cool down. But you decide to use it to dry your clothings in the condensator outside of the refrigerator. You end up making it hottier and the clothing burns and suddenly you have your whole apartment burnt. Guess what, you may sue and win the refrigerator company for blowing up due to your poor use.
