To be perfectly honest, it really doesn't matter what the cop said.  The fact that the man was in a submission postion is really all the evidence you need.  The cop could have said I shot you because I thought you were going for a gun and still it would be the same.

The fact the man got shot is one thing, seeing how the police handle the situation will be something else and should be watch closely.

At what point during the linked video is he seen being shot while in the pose? there is a lot of cuts in that video and a whole lot of editing in both sides of it to make it appear as though no time passes between the footage, but obviously whoever had that perfect clear shot with his cell phone did not continue to record the video or didn't upload what happened at the point where he was shot, why do you think this is? surely the actual shooting of the man on the ground would be the main thing to have included here?

Also if you watch the first link video (I god damn hate having to watch US News more than one time so help me god it isn't a reality tv show, what is wrong with the way people need to have suspense added to their "news" but anyway) Watch the video from 1:20 up til 1:28 watch where Kinsey is in relation to where the kerb / autistic man are on the street right, now watch the angle shown at 1:30 - 1:32 look at Kinseys body on the road... where is it in relation to the previous clip? do you imagine that a non lethal shot managed to flip him across the road from where he was laying? or do you imagine that cops moved in and moved the man that distance to cuff him? Considering the size of Kinsey compared to the 2 cops in that scene I really doubt they would want to be moving a man that size more than 6-10ft just for fun.

Honestly the footage from the phone is proof enough to me that something happened there after that stopped filming and before the actual shooting, also the head of the police department said that the cops bullet went astray and missed? but... who was he trying to shoot if that was the case? the autistic man? or was the chief of police trying to suggest the worst botched warning shot in history?

Either way there is a lot about this story which is not being presented here because it would answer some of the questions which the news station has set up a premium rate number at the end of the second clip to ring for information, both in terms of sensationalising and "clickbaitness" this news station is very much presenting this story as something it isn't or at the very least only presenting the facts that makes it appear much worse.
