Actually they did not say they would be charged with anything, they said they would be under administration which basically is a slap on the wrist when it comes to congress and state officials. People need to discern the difference.
Here is what Comey stated on the case.
"Ultimately, Comey said his recommendation against charges stems from the fact that there is no precedent for charging someone under similar circumstances, saying the FBI could not find a single case in which a person was charged with crimes for similar actions."
If this was the case, Bush would be in prison right after he left the office or impeached when he was found using a personal server for office use.
