Although people have claimed that Japan was in the process of trying to surrender, I believe the claim that they had effectively surrendered already (instead of, say, offering some kind of deal that would have been unacceptable, ergo war continues) is actually completely incorrect.  You may also have heard somewhere that the second bomb was completely uncalled for because they WOULD have surrendered after just the one bomb but hadn't had time to make the decision yet.  But in reality there was a lot of pushback from the military against calls for surrender and desperate speculation that the USA only had the one bomb that they had already used.  They might have surrendered anyway but it was not "obviously yes, no question" even with what we know now let alone what the United States knew at the time about Japanese decision making.

If a city had been A-bombed after the USA was already aware of Japan surrendering then it would have been among the worst war crimes of the war.  Genocide?  I guess that would depend on the motivation for committing the war crime.
