um.... ROE can be adjusted.
If a fighter jet is approaching you in an attack pattern you can shoot the plane down in self defense. In this current case we are assuming that they will not fire. If ROE were adjusted you could easily shoot down said plane and it be sold to international community as self defense. It seems to me that those vessels are on a fire no matter what ROE which would make them sitting ducks in a suprise attack.
Turkey shot down a Russian jet. It was a big deal for a few days and it passed. If a Russian Jet in an attack pattern on a US vessel in international waters was shot down the same would happen.
