I don't think you can technically opt out of the upgrade. I think you can only either opt in or not, and not opting in is not the same as opting out. Please correct me if I'm wrong though.
That said, downloading shouldn't be done automatically, especially in the days of small SSDs. I have Windows installed on a small SSD and having another Windows installation file just sitting there would me pretty bad. And then there's the people with download caps too.

There are tons of issues with Windows 10. And personally I haven't had a single crash on my Windows 7 PC since I got it (a year ago). Didn't have many crashes on my previous Windows 7 PC either. In fact, I don't remember a single one but there must have been some. Just saying it's not even nearly as black and white as you say it is.
