First off, his hads were at his sides. Unless he reached for something in his pocket there is no reason to believe he has a weapon.
Secondly, he actually stops right before he's tased so the presence of the taser is enough for him to back the fuck off.
Is it so hard to say "Come any close and I will have to taze you sir!"
