I think you're the one with little understanding of a contract as depending on the contract the terms vary, they have a contract to publish his games on release but its his franchise, he probably has the option to take it to someone else if SE don't want to publish but then they would gift someone else a tonne of money doing so. The contract may even just be that they be the first choice as a publisher, I know as I deal with contracts often working in business and finance, believe me if the higher ups were in charge you wouldn't even see DQ on a Nintendo platform to begin with, you probably wouldn't even see a PS4 version at this point.
As for the rest of your post, that's the usual "I can't really argue against it " type of response.

From what I'm reading, the contract with SE is exclusive for publishing DQ games. That doesn't mean if SE denies it, Horii can just go to someone else. He signed apparently a pretty lengthy contract that existed before Square and Enix merged together that has maintained that gives SE full, exclusive publishing rights in Japan. Considering a DQ game has never been published outside of Japan first, you can probably imagine that SE denying a DQ game would be a death sentence, and that ultimately implies that projects are brought to SE first to see if they'll approve them for publishing. In the end, even if SE doesn't necessairly own DQ, they sure hold enough power to make a difference.
