Second, to publishers not allowing this: Why not? They can sell you games on a new console without the need of doing *anything* besides allow the game to be played on the bone. There are still sales for 360 games going, a lot. So instead of investing in an hd remaster they don't have to put money on a game anymore and still generate sales with these games. That's what happened also to other consoles, like PSOne Classics or the virtual consoles on Nintendo consoles. Not to mention that even if you already own the games for Sony's and Nintendo's emulation, you have to buy the game again.
So reality check - it will bring money to publishers, this will be a pro for them.

All im saying is you will be surprised, all publishers had to do was ok PS1 games to be on PS3 and it was free money right? But they didnt. The amount of PS1 games re released was pretty pathetic, and the wait and begging to get most of the big ones was a very long wait, especially in europe.
BC is a good thing on the whole, but this isnt true BC, it requires PUB to resubmit there games, which sadly will only be a minority of the 360 library. Hopefully MS are actively pushing to get all the biggest 360 titles.
