In the case of most games, you can justify it because they're small time and they actually NEED the kickstarter money to fund development. They have a refund security if the game doesn't happen, right?
Cancelling after donating would be cruel to be honest, as one time the guy can have the money to do it and all of a sudden he can just lose it.

It's worth than that. If you're halfway trough development and have to refund people, but have already spent part of the money, it's full bankruptcy and if it's an indie developper (in belgian's law at least) the debt will be in the developper's name.
With that said most of the time kickstarter is only part of the money and a motivation for banks and developpers to invest in a game they wouldn't otherwise funded, so the devs wouldn't be that screwed.
