You make it sound like anyone can start a lawsuit, but it's really not that easy. Lawyers are expensive and charge by the hour, and if you're going up against someone who has tons of money, they can just keep rescheduling and either convince you to settle (for nothing), or bankrupt you. 

Anyone with money or a decent shot at winning/getting settlement can sue. Sometimes the negative PR can pressure a company into settling on a lawsuit to just be done with it.
