Well that's part of the problem. I'm guessing Take Two considered it worthy of an M. ESRB just recently declared it AO, and shortly afterwards Nintendo and Sony made sure they knew they won't take an AO game.
It's not like Take Two knew all along it would be AO. Man...it's gotta be pretty horrific to get an AO rating, unless ESRB was a little too strict.
