If I were Nintendo, I would just mark it down from now on to be ruthless with acquiring franchise exclusivity permanently. In the case of Layton, they should have played hard ball until they got a controlling interest a la Fatal Frame, especially when the franchise was still smaller. And not only because it would be better for them, but it also sounds like it would have been better for the franchise based on the new game's description.
